1. Agreement to Terms

By accessing or using ShipBlocker ("Service"), operated by Omnitek Group, LLC, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including our website at shipblocker.onrender.com and our Chrome browser extension.

2. Description of Service

ShipBlocker is a fraud protection tool for e-commerce sellers that:

  • Integrates with ShipStation to monitor incoming orders
  • Allows you to maintain a blocklist of problematic buyers
  • Alerts you when blocked buyers place new orders
  • Optionally places flagged orders on hold
  • Provides a Chrome extension for real-time buyer screening

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscription and Billing

4.1 Subscription Plans

The Service is offered through various subscription tiers with different features and limits. Current pricing and plan details are available on our website.

4.2 Payment

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds will be provided for partial months
  • Your data will be retained for 30 days, after which it may be deleted

4.4 Refunds

We offer a 14-day free trial to test the Service. Due to the nature of digital services, we do not offer refunds on paid subscriptions. Please use the free trial to evaluate whether the Service meets your needs before subscribing.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on the rights of others
  • Block buyers based on discriminatory criteria (race, religion, gender, etc.)
  • Harass, abuse, or harm other individuals
  • Transmit malware or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for any purpose other than its intended use

6. Third-Party Integrations

The Service integrates with third-party platforms, including ShipStation. Your use of these integrations is subject to:

  • The terms of service of each third-party platform
  • Your agreement with those platforms

We are not responsible for the availability, accuracy, or reliability of third-party services.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Omnitek Group, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

You retain ownership of any data you submit to the Service. You grant us a license to use this data solely to provide and improve the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS

We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNITEK GROUP, LLC SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Any damages arising from your use or inability to use the Service
  • Any actions taken based on information provided by the Service

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Omnitek Group, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

13. Changes to Terms

We may revise these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Omnitek Group, LLC regarding the Service and supersede all prior agreements and understandings.
